Harry Doyle murder case about to take a new twist, lawyer to file perjury charges

HALIFAX - It won't be until the end of October, at the earliest, that the case against the wife of

murdered Fredericton businessman Harry Doyle will move forward.

The 62-year-old man was gunned down at a resort in the southern Philippines in August and his wife, Jane Doyle, is one of four people accused in the murder. Philippine National Police (PNP) investigators in Surigao City said Jane Doyle and her late husband's driver, Jerome Devocion, carried out an "illicit affair" and hired brothers Jhonny and Jeffrey Parian, to kill Doyle. There have been several delays in the case and now the lawyer representing Doyle's wife said he'll file a formal complaint against two police witnesses, alleging they are committing perjury. He said he will file a formal complaint on Wednesday against James Musselwhite and Martlaw Ortuina.

Zerda told Global News last month he believed police are trying to pin the murder on his clients because of a bad blood between Harry Doyle and the PNP. He also questioned the credibility of the PNP's two witnesses in the case. Doyle believed American-expat James Musselwhite, who had once been a friend, was behind a February shooting that left a bullet hole in the window of his residence. Police said Musselwhite did not have the means to hire a hitman and did not investigate the accusation - something that angered Doyle greatly, Zerda said. "How can the police claim Mr. Musselwhite has no money to hire the service of people that might have a hand in the killing of Mr. Doyle ," Zerda said in a phone interview Tuesday. "It doesn't cost much." He said Musselwhite has businesses in the Philippines and claims he has no money are false. Musselwhite said in an earlier interview with Global News he lives in the Philippines on about $7,000 a year. "I told them if you bothered to dig deeper as far as the background of Mr. Musselwhite is concerned, you can easily see some clues," he said.

He added Musselwhite knows two former employees of Doyle's -- driver Arnel Sidon and secretary Kima Lenogon -- who have filed form complaints against Devocion. Devocion is accused of shooting and injuring Sidon in May of this year and he's has been charged with arson, in connection with a fire at Lenogon's home. Almazan confirmed to Global News on Oct. 2 police are also investigating in connection with the murder of a retired police officer earlier this year. As for the other witness, who allegedly saw Devocion talking with the hitmen moments before Doyle was shot five times, Zerda said he has heard Ortuina "had some sort of prior contact" with the Doyles. Musselwhite said he fears for his safety. PNP Det. Rose Marie Almazan said police are providing security to both him and Ortuina. "All of these people seem to know each other," Zerda said. He added he will also file a case against lead detectives Almazan and Det. Mark Anthony Miole, calling them "incompetent."

Back in court Oct. 30

Prosecutor Kristina Paat-Salumbides appeared in court Tuesday in Surigao City to get another extension in the case. She will have until Oct. 30 to prepare documents that could lead to charges being filed and arrest warrants being issued for Jane Doyle and the others allegedly involved in the Aug. 12 murder. As it stands now, the case is in its preliminary stages and Salumbides must review all of the police evidence to prove there is grounds to officially lay charges in the case. Jane Doyle has been in Fredericton since Aug. 25, where she is staying with her friend Eva Montanez. If charges are laid against her, police said they will apply to have her extradited back to the Philippines.

he certainly knows how dig a grave for his client. So how about when the police dig deeper on his client?????????? what can of worms will it open??????????? and doesnt he realise that the insurance company and the estate of the late harry doyle (?!) can insist on the DNA of the baby????????? he must be very confident who is the babys father.

Lets not forget foremost the ultimate victim of all this, Harry Doyle. Hopefully the full truth will be realized before the innuendo piles on to deep.

I would like to commend you James. Even though much of the last news article was not presenting you in a very good light, you still posted it here for our members to remain current on where this case is sitting. It just goes to show you do have a good strong character and that you are here doing this to help us find the truth. At this point I think many of us are just sitting back and wondering what is going to happen next...

Anyway, thank you James and I do hope that, in the end, it all comes out in your favour!

he,s a brave man putting himself and his family at risk of harms way helping to get justice for harry ,how many others out there would do the same thing not many thats for sure .one thing I have learned out here is to keep a low profile and be humble and live your life in piece .with so many guns in circulation either legal or illegal and cheap alchohol you have a recipe for disaster .

From the very first post of this thread I was determined to be as fair and balanced as possible, and to do that means that I must post the good and the bad in this twisting complicated trail of events. I never dreamed that Jane Doyle as well as their bodyguard would later become primary suspects in the murder of her husband. I never believed that I would find myself as a witness against Jane and the bodyguard, or that I would be under protective custody and a target of stalking murderers. I never dreamed that these two prime suspects would now try to implicate me in an earlier shooting attempt that I was never considered a suspect, or try to now implicate me directly in the murder of Harry Doyle. I never would have believed that I would have been the subject of this tainted mud-slinging of two desperate souls mired in an excrement-pit of their own making. It has been a strange couple of months.

I myself have to sit here in forced isolation and wait to see what will happen next as this strange tale unfolds. I will still try my best to remain fair and balanced and update information as it comes available in this case. The next few months should prove to be equally interesting. I have faith that all wrongs are rendered right in the end.

If the police were that good at providing security then all the people with money would not need private security guards here. Fortunately, everything I have read about James paints him as a tough ole' buzzard. Take care James. Keep your head down and your defenses up.

Today was the 2nd hearing in the case of the August 12th murder of 62 year old Canadian businessman Harry Doyle of Fredericton, N,B. Two weeks ago the Surigao City police investigators filed their case with the Surigao City courts and presented the case file to the city prosecutor assigned to this case. The Defense was then allowed a two week extension so they could have adequate time to prepare their counter claim, rebuttals, and provide a list of their witnesses to be filed with the court.

Today Defense Lawyer Atty. Zerda failed to submit their counter during this scheduled court hearing. Philippine law now dictates that within the next 15 days, the city court prosecutor will file the required paperwork to the court to request the issuing of an international arrest warrant against Erma “Jane” Undang Doyle requesting her extradition from Canada to face the charges filed against her. The court prosecutor will also be filing to the court for the issue of local arrest warrants against the driver/bodyguard Jerome Tanora Devocion, and the brothers Jeffery “Opok” Parian, and Jhonny Parian.
