Well the best I can tell that by Jerome's lawyer filing a counter- affidavit against the police investigators and all the witnesses, that he wants to sue the police for considering him a suspect, and suing myself and my wife as well as the other witnesses for signing statements telling the PNP what we witnessed as far as his actions and reactions. The fact that no counter claim was filed by Jane Doyle and the two Parian brothers believed to be the two shooters who killed Harry Doyle will now be facing arrest warrants being filed within the next 10 days. I hope to find out more tomorrow by both the PNP and the prosecutor. I will post any correction to this post if my information is not right. It has been a strange and confusing four months I know, and I have a score card and a playbook, but I am slowly learning much about the subtle differences of Filipino law and sanity... . .. 4 Link to comment Share on other sites More sharing options...

As long as she was accompanying her husband (a Canadian citizen), this time will count in her favour towards maintaining her PR status. This made me wonder... When she entered this last time she was carrying his ashes.. So if she kept the ashes and used them each time she entered then she would keep her Green Card active due to this technicality... Wonder if she could manage to get his Canadian passport renewed and then travel with him back to Canada indefinitely??? Popular Post jamesmusslewhite Posted November 11, 2012 Author Popular Post Posted November 11, 2012 The system of the Philippines is an old Spanish Colonial system, Even though the Philippines was a territory of the USA for 51 years the majority of the Philippine legal system is done in English but it is still primarily old Colonial Spanish law. I personally think it was a system purposely designed to allow those the Spanish colonial authorities sanctioned to be in power to be allowed to ruthlessly maintain that power. This protected the upper ruling classes from reprisals from the lower classes. I will explain that belief and give an example of a hypothetical scenario, and the processes of Filipino law in dealing with this scenario. . Hypothetical scenario: There is a Land Don sanctioned by the ruling authority who encounters a legal snag from of members of the less social class There is a Spanish sanctioned "Land Don" who is oppressing the locals in his area and in an attempt to impose his will on the locals under his charge commits a murder . The murder is witnessed and some of the locals choose to come forward in an attempt to try to get justice for this murder. A case of where a person of power power is being directly challenged by the oppressed poor under-class. Here is the legal process as enforced in the Philippines. If the Land Don is witnessed by the police during the committing of this crime than he can be quickly arrested for murder as no arrest warrant is then needed. If the police do not directly witness this murder than someone must come forward to start the process for the filing of charges against this Land Don. This is how the process favors the Land Don against his accusers. 1. First the person comes forward to file a complaint with the police... The police look at the scene get statements from witnesses 2. the police take the witnesses to sign their statements before the "Piscal" and he takes it to the court. 3. the court decides if they will accept the case - At this point the witness statements and names are then public record 4. once public record the information is released to the lawyer representing the Land Don and Prosecutor is assigned (perhaps ask for more time) 5. the Land Don then has 2 weeks to file their counter to the court (perhaps ask for more time) 6. the prosecutor then decides to push the case before the court and then has 15 days to request the issue of Arrest warrants 7. the issuing of arrest warrants are then issued and police can arrest the Land Don so he can await trial. The time the complaint and witness came forward and the arrest warrants are finally issued can take at best 6 weeks and even longer, if the court accepts addition extensions to be filed by either the prosecutor or the defense lawyer. And all through this process the Land Don has all the names of his accusers and is free to either run or simply force witness to recant or make them all disappear... No witnesses, no more, case no problem, and the Land Don just keeps on exploiting the poor. Then There was Marcos, Martial Law, the 1,500 Disappeared, and the People's Power revolt. This led to a traumatized culture fearful of the possibility of another Marcos Regime and Martial law in the future, Law makers then quickly wrote and passed several new laws which were originally written to help stop future Civil rights violations; but in fact with the later twisting of trial lawyers have distorted them to the point that some of these laws restrict the law to the point that they actually help those who take the citizen's civil rights away, due to protections provided by these poorly conceived laws. Evil men can still dominate and maintain their power and control over the poor locals. Modified "Colonial Rules" to lean the court system from the masses to the few. I have learned just how hard it actually is for police investigators here to do their jobs. Compared to the US Judicial process the police here have one arm tied behind their backs before they even start an investigation. These civil rights laws make it very difficult to get even collect basic statements or gather evidence. Example in this case: Jane Doyle and Jerome even though they are prime Suspects both have yet given formal statements to the police and the police can not force them to be questioned and or interrogated. I believe that in the case of the USA legal system, the police could snatch their buts handcuff them to a table and have 72 hours that they can hold, question, and or interrogate. Here these suspects could not be questioned because they refused. Jane Doyle even told the police when they came to question her, "You don't know who you are dealing with!" and then walked away from the investigators who could only leave not having their questions answered. This would not happen in most European and North American countries, because they would have slapped her in cuffs, hauled her to an interrogation room, turned on the heat, and grilled her until time they had to release her to her lawyer. They would have shown her that they fully understood who they were dealing with, a hostile Prime Suspect in an ongoing murder investigation. It is amazing that the Philippine police departments solve as many cases as they do, They do solve a high percentage of crimes here. This I believe quite a feat and speaks well for most police departments because the judicial system is so heavily stacked against investigators here right out of the starting blocks. Yes there are bad cops, corrupt cops, even corrupt departments, but the same can probably be said about law enforcement in all countries. There is also many many dedicated professional and hardworking police personal who do incredible jobs even being faced with poor wages, inadequate budgets, and restrictions imposed on them by arcane and poorly conceived rules of law.
