It looks like a paternity test is the only way of shedding light on Jane's innocence or guilt but the Filipino police don't have jurisdiction to order a test in Canada so the question at this point is will a judge in Canada order the test? And, were Philippine authorities smart enough to keep blood samples of the murdered victim which could be sent to Canada for the test?

At this point, the judge isn't giving Jane all the money. She gave her what was in a joint account. Joint is joint - both people own it. So all Jane got was what is legally hers. Now if she is proven guilty, I wish there was some way to take it back but unfortunately...

The lawyer for both Jane and Jerome filed October 30th to have the case reopened, and to file Perjury and Deformation of Character charges on the investigators and witnesses in the murder case. On November 12th we (PNP investigators and witnesses) were subpenaed and appeared before the prosecutor We were then scheduled to appear before the prosecutor again on January the 11th to formally file our counter-claims. were filed last Friday so the defense lawyer has four more weeks to collect additional witnesses and file counter to the counter-claims filed. We must all meet again before the prosecutor on the 11th of February to allow the lawyer for Jane Doyle and Jerome Devocion to file their counter to our counter-claims, which should be the last opportunity for the Defense lawyer to be able to stall the process of the issuing of the arrest warrants. After this coming February 11th things should start moving rather quickly on the International arrest warrant on Jane Doyle and the arrest warrants on Jeffery and Johnny Paraian.

There is no need to file an arrest warrant on Jerome Devocion because he is presently being held in a prison facility outside of Surigao City. He is being held, without bail, awaiting his upcoming trial on a separate case of Arson which was filed last year by Miss. Kima (Harry Doyle's former secretary). Jerome Devocion is also awaiting the second hearing on the case of the attempted murder of Arnel (Harry Doyle's former driver/ bodyguard) and an addition case on the charge of murder (stabbing and shooting) of a retired PNP officer.

James, you did the right thing.  I know many others would not say so but by doing that which is above what is demanded of  you, you show the type of person you are.  

 

I have a feeling that the lawyer has quit and the defendant is hoping for a miracle along the way.

It seem he is out of MONEY   :hystery:   because the atty hadn't bothered to even answer in a week...

 

Yes, I think too you did corect to not give him any argument for free to the main case.

thanks for the update, still very interested in this eye opening drama about DEATH, lust & greed and a failing legal system put to the test along with International murder suspect's way around the system

Family, friends frustrated with slow pace of Harry Doyle murder case

FREDERICTON - Nearly six long months after the murder of Fredericton businessman Harry Doyle, family and friends are tired of waiting for someone to be officially charged with his death. That's taking a toll on his 24-year-old son, Stephen, who thought his father's killer(s) would be behind bars by now. "This has been the hardest, six or seven months I've had to go through in my entire life," he said in a phone interview from London, England -- where he now lives and works as a school teacher. "Because, I guess, I was under the impression that all of this would be dealt with in a timely, prompt fashion."

Between dealing with the colonial-style legal system in the Philippines -- where Doyle was gunned down at a beach resort on Aug. 12, 2012 -- and the cast of characters involved, the case is as complicated as they come. There are four suspects in the 63-year-old's murder, including his 35-year-old, Filipina wife Erma "Jane" Udang Doyle. She's been in Fredericton since Aug. 25, two days after he husband's memorial service. She was accompanied by their son and was several months pregnant at the time. She gave birth to another boy on Nov. 25. Immediately after her arrival in Canada, Philippine National Police investigators named Jane Doyle as a suspect, along with the couple's driver Jerome Devocion. Police allege she and Devocion were having an affair and hired two hit men -- brother Jhonny and Jeffrey Parian -- to kill her husband. Since that time, there have been numerous delays with the local prosecutor completing her case to file formal charges, which could finally come within the next week, and police arrested Devocion for arson. He's accused of setting a fire at the home of Doyle's former secretary.  Neither of the Parian brothers have been arrested or formally charged, but they have been under police surveillance since they were named as suspects.

Stephen Doyle, who had been estranged from his father for about two years before he was killed, feels there is more than enough evidence for police to issue an arrest warrant for Jane Doyle and request she be extradited back to the Philippines to face the accusations. He said he's shocked there is not more outrage Jane Doyle has been allowed to stay in Canada this long. But, there are people in Fredericton who also feel the process is moving along too slowly and want Canadian officials to step in. "It's time for the Canadian government to collaborate with the Philippine government,"said Bonnie Clark Douglass -- a life-long friend of Harry Doyle's. "I know Harry Doyle and Harry Doyle would stand up for any person in this community (Fredericton) and I think it's time for people in this community to stand up for Harry Doyle," she said. She's writing to federal and provincial politicians -- including Foreign Affairs Minister John Baird and Citizenship and Immigration Minister Jason Kenney -- and organizing a petition to urge to seek justice for the murdered businessman.

Even though there are not yet any formal charges against any of the suspects, she said she sees Jane Doyle's prolonged stay in Canada as averting the law. Since arriving in Fredericton she has been staying with her friend, Eva Montanez, and she hasn't been seen much. Global News attempted to contact Jane Doyle at a number listed to an "E. Montanez," which has been disconnected sometime since September. "Jane came here knowing she was a possible suspect," she said in an interview with Global News. "How did she get out of the country... And how did she access our justice system when she's not a Canadian citizen?" A judge in Fredericton recently awarded Doyle's widow about $100,000 from a bank account the couple shared. The rest of Doyle's estate has not yet been dealt with, but Stephen Doyle said it's worth about $1.6 million.

Clark Douglass, a former St. Thomas University criminology instructor, said she began to suspect the murder was not a random act within days of the shooting, at a resort area near the Doyles' home in Surigao City. "Within two days [i knew] something wasn't right," she said. "All of the facts that were coming in didn't line up, even right from the get go." She hopes getting some sort of response from the government might ease some of the stress on Doyle's adult son. Stephen Doyle is grateful, but not entirely optimistic about what petitioning politicians to help will due to bring his father's killers to justice. "It would be great if we could shed some light on this, if we could bring this to the attention of the public," he said. "It's like everyone sort of forgot about this, but me." The local prosecutor, Kristina Paat-Salumbides is due to return to court on Feb. 11, at which time she could finally ask for charges to be laid against all four suspects.

Witness in Doyle case fears for life

One of two key witnesses in the case against Jane Doyle, Devocion and the Parian brothers is an American-expat by the name of James Musslewhite. Stephen Doyle has been in constant correspondence with him about the case and calls him a "hero" for "standing up, when no one else would."But Musslewhite believes speaking out could leave him vulnerable to a fate much like Doyle's. In a Facebook message, Musselwhite said he and the investigators could have their lives targeted. The message read: "The word came down the bamboo network that a hitter was contracted out of Davao to target the investigators and witnesses in an attempt to pin us down. The PNP (Philippine National Police) office who sent me the text yesterday afternoon said he had a 50,000P bounty on his head. I believe it to be true because of the source." Although Musslewhite claims he saw Jane Doyle and Devocion meeting with the men suspected in the shooting, he was also once accused of trying to kill Harry Doyle. Doyle believed Musselwhite was responsible for a failed attempt on his life, after a bullet was fired the window of his home on Feb. 3, 2012. The friends had an early falling out over money and had not been on speaking terms. The police dismissed Doyle's claims and did not investigate Musslewhite. Global News asked Stephen Doyle about his father's former friend. He said it wasn't unheard of for his father to have disagreements. "That's typical Harry," he said. "You meet him, you have a falling out with him. As soon as you have a good conversation with him, a dark, cynical one is to follow... That was his nature."

Regardless, the lawyer representing Doyle's widow has tried to discredit Musselwhite as a witness. Edumundo Zerda said previously all of the police accusations against Jane Doyle are payback for Doyle being upset with investigators for not pursuing Musslewhite in the earlier shooting. Global News contacted PNP detective Rose Marie Almazan about Musslewhite's safety. She did not confirm there was a threat against him, but said they have and will offer police protection if needed. "We told him anytime that he notices anything unusual, he can call us," Almazan said.
