Thomas Posted August 13, 2013 Posted August 13, 2013 This was why the Doyle family wanted a DNA test as they knew in advance that the baby as going to be full Filipino, as they want to know if the child is in fact fathered by Jerome Devocion. This would greatly conflict with statements made by Jane Doyle here in the Philippines and in Canada. Some could consider it a motive to having to have him killed, but have little to no effect on the newborns inheritance rights.Do you mean the Canadian law is that stupid, that the new child can't be out of inheriting even if it's proven it isn't Harry's and it's questioned in court?? That I can not answer. I just know what I am told by those who know what is going on in their own personal lives. Have any of them questioned a will in a similar situation in a Canadian court? Contesting the new child as heir too? Canada, as for the send part of the question I do not know. I was was told that Canadian law dictates the right to Citizenship and the right to the inheritence. As for as I know there is no contesting because the child will be rewarded the even share as the other heirs providing the new Will is not accepted by Canadian law. In that case Jane Doyle walks away with everything and the kids are out of the Will. Daily Gleaner, Fredericton Aug, 15, 2013 by: Tara Lynn Chislett It’s been one year since Harry Doyle was gunned down by two men at the Palma Resort in Punta Bilar, Surigao City Aug. 12, 2012 while attending a family picnic with his wife, Erma (Jane) Doyle and their 12-year-old son, Joseph. Doyle, who had been living in the Philippines for almost 10 years at the time of his death, was shot five times in the chest, abdomen and upper left leg and died on the beach in front of dozens of witnesses. Widow Jane Doyle, family bodyguard Jerome Devocion and two other men, Jeffrey and Johnny Parian, were charged with murder last September. Of the four, only Devocion has been arrested on another matter. Jane Doyle has been in Canada since last August, arriving shortly after her husband’s slaying. While in Canada, she gave birth to a baby boy. On Aug. 2, the prosecutor in the case filed a resolution in court requesting arrest warrants for all four charged in connection with the case. The resolution, obtained by The Daily Gleaner, reads.“Wherefore and for reasons aforestated, let an information be filled in Court charging respondent, Erma “Jane” Undang Doyle of Parricide and another information be filed in Court against respondents, Johnny Parian, Jeffery “Opok” Parian, and Jerome T. Devocion for Murder. No bail recommended on both cases, so resolved. Surigao City, August 2, 2013,” The resolution was signed by Manuel N. Tesiorna, Jr., the city prosecutor who has been assigned the case after prosecutor Kristina Paat-Salumbides stepped away. Although warrants have been requested, they have not formally been issued yet. Stephen Doyle, Doyle’s eldest son, said he found out about the resolution last Friday. “It was unexpected,” he said in a telephone interview from Ontario Wednesday afternoon. “I was told that this was going to happen in March. Then it was April. Then it was June. Then it was July. I was told for sure July, the first week, count on it. I basically was told it’s coming so much, that when I was told I was shocked even though I had six months of preparation. It was almost like I had given up hope and thought maybe it’s not coming or maybe, perhaps the resolution would be that they’re not in fact charging her. “That’s what I feared the most, someone would say, ‘Oh, she’s gone, she’s never coming back, water under the bridge, there’s not enough evidence.’ What this resolution means is that in five to 10 business days, the arrest warrants will be out. It’s good. What this means is we’re expecting the arrest warrants very quickly. It means that this fantasy world of Jane’s, using Fredericton as her playground, is coming to an abrupt halt.” Stephen Doyle said he will likely travel to the Philippines to attend the trial. “I think the judge needs to understand that this wasn’t just some old rich man,” he said, adding the death of his father turned his world upside down and has even caused rifts between the family and some former acquaintance and colleagues who he said have sided with his father’s widow. “This guy had kids. He had sisters. When you take someone out of commission, when you murder someone, you’re not just attacking that one person. You’re attacking an entire family and friends.” Bonnie Clark-Douglass, a longtime friend of Doyle’s who spearheaded a petition to the Canadian and Philippine governments to have Jane Doyle sent back to the Philippines, said she was pleased to hear warrants have finally been requested. “While the process took almost a year from when our friend Harry was murdered, we are all relieved that justice is finally starting to work,” she said. “We were not giving up, and we are so happy for his son Stephen, his sisters and family members.” Clark-Douglass said she’s thankful for the friends she’s made in Suriago City who have been working to keep Doyle’s family and friends at home informed. “We thank them for extending their hand of concern for Harry’s justice,” she said. “The dignity and integrity they have had in standing tall in the face of all they have had to endure, while their lives were threatened is admirable. We look forward to watching the justice process unfold and hope and pray that Harry’s killers will be prosecuted.” James Musslewhite, one of the witnesses in the case who has been active in online communities designed to keep family and friends of Doyle updated on proceedings in the Philippines, said although the request for arrest warrants was a major development, there are still concerns to be dealt with, especially when it comes to the safety of witnesses. He said several key witnesses have either relocated or gone into hiding after attempts on their lives. “I just hope I live to see this case concluded. Our son is now in the U.S. after he graduated high school this year so that relieves a little of the tension,” he said. “My wife and I are both standing firm as we know what we saw, and we know what we are doing is the right thing to do. Time will tell what happens in this case, so all we can do is have faith in the Lord and let the court process proceed.” Musslewhite said he hopes Canadian authorities demand the National Bureau of Investigators investigate all witnesses and their statements to determine their truthfulness. Stephen Doyle said ultimately, he’s grateful for people like Musslewhite and his father’s sisters, Anne and Joan, who have worked so hard to bring the case this far. He said in the end, what he wants to see is four convictions. “I think some time in a Filipino jail cell would give some time to reflect. Yes at the actual shooting scene there were several witnesses who have signed sworn statemnts as to the shooters and the actions of all the perople who were with harry Doyle's group. There were also several witnesses at the Mario's Restro who witnessed the public meeting with Jane, Jerome, and Johnny Parian (one of the shooters) eleven days before the killing of harry Doyle. 3 Link to comment Share on other sites More sharing options...

An arrest warrant has been formally issued against Erma "Jane" Undanq Doyle on the charge of "Parricide" and against Jerome T. Devocion, Johnny Parian, and Jeffery "Opok" Parian on the charge on "Murder" in the murder case of Harry Doyle. In the Philippines "Parricide" is a crime committed by any person who shall kill his a). Father or mother b). Child whether legitimate or illegitimate c). Legitimate ascendant d). Legitimate descendant e). Lawful spouseParricide is punishable by the penalty of reclusion perpetua to death. As the Philippine had passed and signed in law a hold on all death penalty convictions it would carry a maximum punishment up to a life sentence. In January 2002 the supreme master of the Philippine Benevolent Missionaries Association (PBMA) and Dinagat Island Representative Ruben Ecleo Jr. was found guilty of "parricide" for the death of his wife. I believe they chose it because unlike murder it is a non-bailable offense. I believe the fear is that with the money she had already receive while in Canada would allow her to pay the bail imposed and then flee trying to elude the charges. Jane had already showed that she was willing to be illusive and uncooperative; and perhaps intentionally tried to allude the investigators, and with purpose refused to answer their questions, or helping to assist in their investigation in the murder of her spouse..
