Woman Slips On Steps, Sues 5-Star Cebu Hotel

A WOMAN who slipped and fractured her foot in the parking lot of a five-star hotel in Cebu City filed a P1 million damage suit.

Elsa Go of barangay Guadalupe, Cebu City sued Marco Polo Plaza, saying the accident was caused by the “extremely slippery surface” of the steps of the parking lot.

She and her husband attended a birthday party of Maximo Go Sr. at the hotel on June 28, 2013. After the party, the couple walked to their car past 9:30 p.m. when the woman slipped.

As a result of the fall, Mrs. Go said she wasn’t able to work for two months and spent P13,000 for hospital treatment.

Sought for comment, the hotel’s general manager Julia Nacar yesterday said the incident happened during a rainy evening despite “precautionary measures in place to eliminate the risk of accidents.”

 

“We offer umbrellas, valet service and the parking lot is well lit. At the time of the incident, it was raining and it was night time. The complainant walked to the parking lot and when she slipped in the rain, the security guard who saw her offered the services of our nurse on duty. However, the offer was declined and the complainant drove off. We are sorry that our offer to assist was refused,” said Nacar in a press statement.

In her complaint, Go alleged that the hotel was “negligent” in its duty to ensure the safety of its guests.

She said that no hotel staff or guard was around when she fell and that her husband had to leave her temporarily to look for a security guard to help them.

Go said they were advised that there was a clinic in the hotel, but since she was in severe pain, the spouses went directly to the Emergency Room of Chong Hua Hospital. She was treated for a severe fracture in the right foot.

Named defendants in the complaint are Marco Polo Plaza Hotel Cebu, its owner Cathay International Resources Corporation, and the Swiss general manager Johannes “Hans” Hauri.

Go is claiming P100,000 in lost income, P850,000 in damages, and P70,000 in attorney’s fees and litigation expenses as well as the cost of the lawsuit. The civil case was filed through her counsel, the Aumentado Duallao & Ponce Law Office in Cebu City.

Ha, Ha, I was wondering how long it would take Filipinos to get into the American culture of suing for everything and anything, and demanding absurd amounts of money for what most people would consider a "simple accident, caused mostly by the woman's own stupidity.

 

Now watch the medical bills go up, because the doctors have to pay the increase in their malpractice insurance, etc. etc. etc.

 

And of course another member of the Go family, (I believe a good portion of that family live in the US). Like that family don't have enough of other Filipinos money already!

 

Not to mention 100,000 for lost income, since June 28th! Ha she must work for the Department if Immigration, or the Department of Customs, or....., need I say more!

 

850,000 in damages, for a sprained ankle!

 

Men have gone to war for our freedom and lost more than that and received less!

 

70,000 in lawyers fees, well they do work for the Go family!

 

People should rise up and put this women in her place, look at the suffering of the majority of Filipinos, and make this woman and her family face the shame that they should for being such a ....., oh I better stop there.

2GO is getting sued for their sunken ship.  Maybe its a family member trying to recoup some losses in like fashion.

I like the British tort system. You can sue, but if you lose the case, you pay the expenses for both sides. This stops the frivolous lawsuits. In the United States, lawsuits are a form of extortion. Either you pay for it to go away or face huge costs for attorney's fees, court fees and settlement if the judgement is against you. Even if you win, you lose.

 

Walmart was experiencing an average of one parking lot lawsuit per day. This includes claims of sexual assault by another motorist. They decided to fight every one irregardless of attorney's fees. The lawsuits stops because the plaintiff lawyers receive 40% plus expenses from any out of court settlement. If the case goes to court, the process could last years and the attorneys might not get paid. The Disney Corporation did the same thing.

I know that hotel really rather well and the steps leading to/from its parking lot have handrails and a non-slip surface. Those steps are, incidentally, close to and in full view of the main doors at which there are always armed security guards as well as hotel security personnel so I doubt the plaintiffs' account that the husband had to go find a security guard. Her claim for 100,000 Pesos for loss of two months' salary fails the reasonableness test, IMO, unless she claims she is a highly-paid floorwalker at SM Department Store. A broken ankle does not prevent you working at a desk!

 

I suggest that this woman decided to wear an inappropriate pair of shoes - inappropriate for their height, her age and the weather. That coupled with a few glasses of champers would have meant that she was a bit unsteady on her legs.

 

Case dismissed!

Had there been any other complaints about the steps? Was Marco Polo trying to cut corners by not correcting known problems? What are ALL the facts?
