I agree with you Robert, so with the pacifier or without it what the nurse did was wrong and endangered the baby's life.

 

It may also be considered as torture if someone did it to the nurse, but the baby can't talk.

If News Reporters were more competent at their jobs then we would have more details to base our opinions on. Why didn't the reporter say why the father is refusing to file charges? All the reporter has to do is ask him. Incompetence is my guess.
Or perhaps the hospital have paid/reduced the bill to the father to shut up   :)

Most hospitals don't allow pacifiers so if they were using one they were probably violating their own policy. This story has "gone viral", it's being carried worldwide, almost all the headlines are "baby gagged by tape". I don't think that's what happened. These nurses work in a maternity hospital, surely they are used to crying babies. Newborns spit up a lot, they would know that by taping a baby's mouth shut to prevent crying they are also closing an airway and in the likely event of the baby spitting up it could easily drown in it's own vomit. Does anyone really think that they routinely tape up babies' mouths to prevent crying? The father had been saying from the beginning he doesn't want money, he just wants the hospital to acknowledge the mistake and deal with the ones who did it. Now he's hired a lawyer and announced plans to sue the hospital. He doesn't have to sue the hospital to get the investigation going all he has to do is sign the complaint. The hospital has already done an internal investigation but they haven't released the findings. At the very least the nurses involved violated hospital policy by using a pacifier. This needs to be thoroughly investigated by the independent governing agency that has jurisdiction, not tried in the self-serving media and facebook.

The hospital offered to discount the bill, he refused and paid the full amount.

The Philippine Nurses Association-Cebu Chapter (PNA-Cebu) has finally broken its silence over the mouth-taping of a 1-week-old baby by one of its members.

The baby's parents alleged that one of the three on-duty nurses at the Cebu Puericulture Center and Maternity House Inc

. told them that they needed to put a pacifier on the baby's mouth and an adhesive tape to hold the pacifier because the child was crying.

The incident occurred last May 9.

 

Despite criticisms from netizens, the PNA-Cebu is hoping that this will not demoralize the nursing profession.

"It is simply an isolated case because accordingly it only involves one nurse

 

and does not indicate the entirety of the nursing population," said Edith Rose Santos, president of PNA-Cebu.

Santos said they are still waiting ... for the results of the internal investigation conducted by the involved hospital.

She called on the public not to immediately judge the nurse,

Now lets see, the one nurse was the only one on duty and she never got a break? Evidently no other nurses or a doctor wandered through? I think I found that power source we have been looking for, perpetual spin.

Maybe the nurse's previous job was at Gaisano where they tape up and staple everything.  Well, at least she didn't staple his lips shut.

THE Cebu Puericulture Center and Maternity House (CPCMH) insists its staff had nothing to do with the taping of the lips of a newborn in its nursery.

In a two-page incident report to Department of Health (DOH) 7 Director Jaime Bernadas, the hospital’s medical director Raida Varona also denied they placed a pacifier near the said that aside from denying that they place any tape on the baby, they also denied that a pacifier was placed near the baby.

But officials of the inter-agency task group formed by the Regional Subcommittee for Welfare of Children (RSCWC) were not satisfied with the hospital’s report and plan to summon both parties tomorrow for a full-blown investigation.

The hospital’s reply also reportedly upset the baby’s parents.

‘Merely a denial’

Cebu Archbishop Jose Palma, for his part, urged those responsible for the incident to realize what they have done.

In a press conference, Dr. Lakshmi Legaspi, DOH 7 assistant director, said they received the hospital’s report around 1 p.m. yesterday.

It said the nurse at the time of the incident did not see any plaster of pacifier on the baby’s lips.

Varona also said the hospital prohibits the use of pacifiers for breastfeeding infants, as it is an accredited mother-baby friendly hospital.

She said the nurse whose attention was called by the baby’s mother claimed she was surprised to see the plaster. But despite that, no complaint or even a report was filed before them, she said.

Varona said the baby’s father, Ryan Noval, entered the hospital’s Special Intensive Care Unit (SICU), where the baby was staying, wearing nothing but street clothes and carrying a backpack.

The SICU is considered a sterile area and allows only breastfeeding mothers, Varona said.

“For us, it’s not a valid report. It’s merely a denial. They just shifted the accusation to the father just because he brought a backpack in the hospital. Dili gyud siya makiangayon nga report (It’s not a satisfactory report),” said lawyer Dante Jadman, the RSCWC’s appointed spokesperson.

Jadman, who represents the Commission on Human Rights 7, said they also requested the National Telecommunications Commission (NTC) to authenticate and certify pictures of the baby taken by the parents and those that came out in social media.

Lawyer Alan Felix Macaraya, NTC 7 legal officer, said the results of their authentication will come out by Friday.

Jadman said they needed NTC’s certification after the hospital’s lawyer said the pictures had been edited.

Parents’ reaction

After reading Varona’s reply, Noval and his live-in partner Jasmine Badocdoc couldn’t help but be emotional.

“To the (hospital’s) lawyer: ‘Get your s**t together.’ We are coming, okay. This is not fun for us, it’s actually hell. It would be illogical for us to actually put tape on our baby and to fabricate this story. With this notion from your side, it actually angers me. That’s the reaction that you want, you will get the result,” Noval told reporters yesterday.

While he had expected the hospital to protect itself, Noval said its latest denial was just too much.

“Since we threw the first rock at you, defend yourself. And you have every right to do so. But now, you’re playing dirty. And we’ll stay to play clean and justice will prevail,” he said.

In reaction to the controversy, Palma told reporters that everyone has the responsibility to others.

“We know that all of us are our brother’s keepers. We have a responsibility to others, especially to the innocents and those who can’t care for themselves,” he added.

Palma added that while it was sad to know that a child would suffer such cruelties, it was more lamentable when the people tasked to take care of children would do such acts.

He hopes health providers will strive to take care of others and to provide service for the good of others.

Unfortunately, this text only internet version doesn't include pictures of the parties and other graphics like the timeline of the nurse-supervisor's duties of the day in question. If they are correct she worked at least a 20 hour shift from 3pm on 5/9 to 11am on 5/10. I wonder if that is unusual. The parents have still not filed a formal complaint against the hospital or nurses by executing a sworn affidavit. 

"Nurses speak up: We didn’t tape baby’s mouth

CEBU CITY -- The nurses on duty when a baby’s mouth was taped in the nursery of the Cebu Puericulture Center and Maternity House (CPCMH) denied they did the deed.

For the first time since the incident happened some two weeks ago, nurses Arianne Mae Pacula and Kamille Isabela Neri came out and faced a fact-finding investigation conducted by the Regional Subcommittee for the Welfare of Children (RSCWC). Pacula revealed Friday that before the baby’s mother, Jasmine Badocdoc, arrived at the hospital last May 9, there was no tape found on the infant’s lip. Lawyer Cornelio Mercado, who represents Pacula and the hospital, said that his clients were willing to undergo a lie-detector test. The incident, first made public through a Facebook post by the baby’s father, has provoked a public discussion about the quality of newborn care in health facilities. Before members of the RSCWC on Friday, Pacula revealed that she had encountered Badocdoc around 7:30 p.m. last May 9. Pacula said that while on duty at that time with Neri and a midwife, she noticed that Badocdoc was waiting in the hospital’s Mother and Child Room (MCR), where mothers would breastfeed their babies.

Pacifier

Pacula recalled telling Badocdoc that she may have to wait until the baby woke up. While Badocdoc was waiting in the MCR, Pacula returned to the nurses’ station. A few minutes later, she said, she was surprised that Badocdoc had entered the nursery and asked her why there was a piece of tape on her baby’s upper lip. Pacula said that when she and Badocdoc went to the baby’s crib, she saw, apart from the tape, a pacifier near the baby. “I was even surprised nganong naa’y (why there was a) pacifier,” Pacula said. But contrary to Badocdoc’s testimony, Pacula said that the mother still breastfed her baby even with the tape on. Pacula said that even with the tape, the baby was able to suckle. Pacula told the committee that she then left Badocdoc and had dinner with her fellow nursery workers in the wash room. While eating, they would check the nursery from time to time. After dinner, Badocdoc reportedly approached Pacula and asked her to remove the tape as she was afraid to remove it herself.

Nurse ‘troubled’

Pacula had promised Badocdoc that she would remove the tape if she would return the baby to his crib. After returning her baby to the crib and changing his diaper, Badocdoc then reportedly left the nursery. Pacula said that because she had so much to do, like charting and checking for laboratory tests of the babies, she was not able to remove the tape from Badocdoc’s son. But just as she was about to endorse her records to the next shift at 11 a.m. the next day, Pacula claimed that when she checked on Badocdoc’s baby, the tape and the pacifier were gone. “I felt troubled by this. I’m always concerned about how the people would see me after this incident. I don’t know why the parents are putting the blame on me,” she added. But Badocdoc clarified that she never named Pacula since the controversy began because she was not sure if the latter had placed the tape on her baby. On her part, Neri claimed that Badocdoc never mentioned the tape on the baby’s lips. Neri was the medication nurse at that time. Neri said that while Badocdoc was in the nursery, she never reported the matter to her or to the midwife on duty.

Curiosity

But Badocdoc, for her part, said she was disappointed with the hospital staff’s insinuation that she had given her baby a pacifier and put a tape to hold it in place. “Sinong nanay na nasa matinong pag-iisip ang plasteran ang anak niya? (No mother in her right mind would tape over her baby’s mouth.) It’s so disappointing that the people we entrusted with our kids’ safety would harm them,” said Badocdoc. She also denied speculations that the photos she and her partner took of their baby were altered. But Mercado clarified that they only want to check if the photos have time stamps to determine when these were taken. The first photo, snapped with Badocdoc’s cell phone, was taken at 7:58 p.m. while the last one was taken at 8:08 p.m. Mercado also revealed that Badocdoc was previously reprimanded by duty nurses at the nursery after she was caught taking pictures of a baby having her husband’s last name. But Badocdoc explained that they entered the nursery as no one was there and she was curious if the baby may have been a relative of her husband’s.

Protection policy

Despite continuous prodding, officials of RSCWC failed to determine who placed the tape and the pacifier on the baby. The whereabouts of the tape and pacifier are also unknown. Lawyer Dante Jadman, who chairs the inter-agency task force, has required the CPCMH to submit the footage of their closed-circuit television (CCTV) cameras and their security logbook to determine what time Badocdoc arrived at the hospital. The CCTV footage and the security logbook came to light after Badocdoc raised the matter to the inter-agency task force. The Department of Social Welfare and Development (DSWD), a member of the inter-agency task force, also required the hospital to submit their child protection policy.

Mercado, for his part, said they were willing to submit all of the requirements sought by the RSCWC. “The important thing is that we ferret out the truth,” the lawyer added. (Sun.Star Cebu)"

Nothing surprises me these day with maternity care in Philippines. We often bring patients into Vecenti Soto with active TB, and the nurses put them on a strecher, and put them about 2 metres from the entrance to the Critical Care pedi ward....go figure. :1 (103):  :1 (103):
