Jollygoodfellow Posted March 23, 2015 Posted March 23, 2015 Oh what a tangled Web we will weave here, Firstly, Jack has been Granted a One Year waiver to remain in the Country he will be safe until the BB Expires. But are you sure as he is a minor depending upon an adult who carried him through immigration of which will be departing without him.
Jack Peterson Posted March 23, 2015 Posted March 23, 2015 But are you sure as he is a minor depending upon an adult who carried him through immigration of which will be departing without him. How do you do that? Confuse me with just one sentence. What I mean is he will have leave to stay until the BB Expires. ie not an illegal Alien, and of course I did say, leaving him here is not a good Idea. What I think you are saying Jack is that the baby Jack has the right to remain in the Philippines until the end of the BB privilege but I think this will cancel out if his parents leave. As you can see the below does not address the issue but makes me think that as for a child the parent must be accompanying the child throughout the whole length of the BB. 4. Can a foreigner spouse or child of a Balikbayan avail this privilege when traveling to the Philippines alone? A foreign national spouse and/or child of a Balikbayan may only be given the said privilege if he/she is traveling with his/her Balikbayan spouse or parent. http://www.immigration.gov.ph/index.php/faqs/visa-inquiry/balikbayan-previlege

Hmm well yes I can see that, so little Jack will have to go Home to Ozz after all. unless he can get his recognition and/or a filipino a passport, Hope all goes well for them. i am bob Posted March 23, 2015 Posted March 23, 2015 I tab across this before while looking into gyve BB package... Basically comes down to bring allowed into the country together and, when the person qualifying for the BB (in this case, the Mrs) leaves the country, so must those who came under her BB privilege. So Big Jack was right in saying that Little Jack needs to get his citizenship asap if he is to remain behind.. But then he also has to be left in the care of a person qualified in the eyes of the law... And I'm not talking a caretaker but more like close family.

I have some personal info from the OP before this topic started and assure you that there is a qualified family member to take care of Jack. Little Jack that is as big Jack is not using adult diapers yet. :mocking: Sorry JP :1 (60):
Whitty Posted March 23, 2015 Author Posted March 23, 2015 We are leaving for Cebu City tomorrow morning...We are hoping that what is best for Jack will be the outcome. That is to stay in the loving care of his Grandma and Grandpa and the family here .It is still fresh in my mind what he went through on the flight from Aussie in Feb . There is also a great deal of driving involved in our time in Aussie..He is so settled and content here .Seems crazy to bring him. We are just going back to Aussie for the marriage of my Daughter . We will be coming back asap after that. Does that mean, for example ,if Emilou flew out of the country, Jack and I are no longer under the BB visa and could be in some sort of trouble? If this is so , after i get Jack sorted out will focus on getting another visa ,maybe a 13 A ..... Thanks to all for the objective view of this situation.....will let you know how we get on ...Cheers
