A US Marine charged with murdering a transgender woman in the Philippines put his mother on the witness stand to start his defence Monday, lawyers said.
Lisa Pemberton testified to the "good character" of her son Joseph Scott Pemberton at the closed-door trial in the northern port of Olongapo, his lawyer Rowena Flores told AFP.
He is detained at a Manila military camp, accused of murdering Jennifer Laude whose remains were found in an Olongapo motel room in October 2014 shortly after the two left a local bar together.
Pemberton had been taking part in joint US-Philippine military exercises nearby.
The case has attracted national attention as the Philippines seeks closer defence ties with the United States in the face of Chinese territorial claims in the South China Sea.
The mother, said by court officials to be a 44-year-old nurse, was the first defence witness after Filipino prosecutors had presented their case.
Flores would not say if or when Pemberton himself would take the stand.
"Twenty-two people sent letters to show (the) good character of Pemberton.... (His) mother identified the letters," Flores said.
They came mostly from family friends, she added.
"I have never known him to exhibit any signs of hostility or violence. To the contrary, he has a reputation of 'never hurting a fly'," the mother's best friend Diane Rioux was quoted as saying.
"Joseph has always been a non-judgemental person who is accepting of others' differences whether it is cultural, race, sexual orientation or other," she added.
Harry Roque, a lawyer for the victim's family, said the mother also testified that her son did not discriminate against gay people.
The judical proceedings are expected to be completed this year.

When a foreigner gets murdered it gets a few lines on page 2 and continued on page 32...After that..Silence.

I attended the funeral of the Austrian that was murdered last week...Not even the Barangay captain turned up.

Why don't they INSTEAD make it with the case where an American (related to the Embassy) were stabed to death by two RICH Filipinos, who got (almost? *) no pubishment?...  :1 (103):

 

*At least they were let out BEFORE the judge have decided, meaning the judge DIDN'T find it be any serious crime!!!  :bash:

They only care when a Filipino gets killed - no one here cares about foreigners.  Life sucks, but the rent & rum are cheap, and the girls are cute.  :tiphat:

MARAWI CITY – Four detained suspects who had confessed to raping and murdering a 13-year-old Maranaw girl on Aug. 14 were found dead behind an abandoned hospital in the city outskirts, officials said yesterday.
No one from the city police could explain how the suspects, who were held at the Marawi City jail, disappeared from their cell and ended up dead with gunshots to the head.
The slain rape suspects, Jabbar Macacua, Elias Pimping, Salman Udag and Jalil Sani, had all admitted their involvement in the brutal gang rape and murder of the Maranaw girl on Aug. 14.
They were arrested a day after the incident and were immediately detained at the city jail.
The suspects were reportedly spirited out of the city jail by a group, to be taken to Bayang town in the first district of Lanao del Sur, hometown of Vice Gov. Haroun Al-Rashid Lucman of the Autonomous Region in Muslim Mindanao.
The rape victim was related by blood to Lucman, according to local officials

THE Bureau of Immigration (BI) has issued a deportation order for Private First Class Joseph Scott Pemberton who is facing trial for the murder of Filipina transgender Jennifer Laude.

In a five-page resolution released Tuesday, the BI said Pemberton is “a risk to public interest for being an undesirable alien.”

But the BI clarified that Pemberton will only be deported once his murder case has been resolved.

The BI based its resolution on the filing of murder case against Pemberton.

Citing a memorandum dated Nov. 24, 2014, the BI said “a foreign national is undesirable if he commits an act constituting a criminal offense punishable by imprisonment of one year or more.”

“In this case, respondent was charged before the Regional Trial Court, Branch 74, Olongapo City for the crime of murder. Obviously, such serious criminal offense carries a penalty of more than one year. Thus, the case of Pemberton falls within the ambit of the said Operations Order. He is therefore presumed to be undesirable,” the resolution stated.

While Pemberton is still presumed innocent considering that the court has yet to rule on the evidence presented by the both parties to the murder case, the BI said in deportation proceedings, “even an iota of evidence that an alien is unfit to remain in the country is sufficient.”

Upon deportation, he will be included on the BI’s blacklist.

Meanwhile, counsel for the Laude family, Atty. Harry Roque, said the BI’s resolution is a welcome development.

“It was at the instance of the Laude family that he was made subject of deportation proceedings. It proves that he is indeed an undesirable alien arising from the killing of Jennifer,” Roque said in a statement.

Yeah I saw an article about the deportation order... seems a bit daft.

 

If he is found guilty he will go to jail - so not deported.  If he is found innocent I bet he gets out of here as fast as he can and never comes back.  I would swim away if I had too.  BI just wanted to get their jab in too,  Typical.    :tiphat:

Do they mean the ONLY punishment for a murder is deportation??!
