American arrestedCEBU, Philippines - An American national spent his birthday in jail yesterday after he was arrested last Sunday when he was caught taking a video of seven topless women in a “cat fight” in Barangay Malbago, Daanbantayan.The American, 34, a native of West Virginia, USA was arrested by Malbago Barangay Captain Vergilio Misa and Barangay Intelligence Network members Danilo Villegas and Luciano Malinao.They made the arrest following a report from a concerned citizen. PO2 Alfredo Mandal of the Daanbantayan police said three of the victims are minors, ages 14, 16, and 17.Two of the victims are from Barangay San Vicente in Bogo City; another is a resident of Barangay Malbago in Daanbantayan; while the rest come from Barangays Sawang Calero, Mambaling, Pasil and Lahug in Cebu City.The FREEMAN is withholding the names of the American and the women, considering the nature of the case.The women were reportedly recruited separately by a certain Sheryl who promised to give them P1,500 each.According to the 14-year-old girl, Sheryl had approached her and said she could earn P1,500 if she would participate in a “cat fight” in the nude. When she agreed, Sheryl gave her the address of the American and told her the time they were to meet.Mandal said all victims arrived at the address in Barangay Malbago one by one. The American was already waiting for them there.“Didto na sila nag-abot tanan sa lugar kay wa mani sila ingon gidungan og haylo, gitagsa-tagsa man,” Mandal told The FREEMAN.A woman who passed by the place reportedly asked one of the girls what they were doing to which the girl reportedly replied, “mag-camping camping ra man mi.”The site is about 100 meters away from the nearest house.Mandal said the “boisterous” laughter from the area prompted the woman to check closer and that was when she saw the girls topless. She immediately reported the same to the barangay captain.The American was turned over to the Daanbantayan police. His camera and battery pack are also under police custody. Meanwhile, the girls were placed under the custody of the Department of Social Welfare and Development 7.The American said the recording was just for entertainment.“They are just wresting around and not harming each other. I don’t know why and it’s a damn thing,” he said.The American has been in Cebu City since mid-January and has lived in Barangay Bungtod, Daanbantayan with his Filipina fiancée who is three months pregnant.Mandal said the fiancée is reportedly aware of the American’s activities, but kept the same to herself.The American admitted he has initiated the “play” several times but it was the first time last Sunday that he did it outdoor.“We did it before inside the house and I didn’t give them money. They only come to me if they need money for their children,” he said.He said his parents got disappointed when he called them yesterday and told them about what happened.“I won’t say too much, I know I’m not what they think I am but I’ll have my lawyer to protect me,” he said.He is facing charges for violation of Republic Act 9208 or the Anti-trafficking in persons Act of 2003 and Republic Act 7610 or Anti-Child abuse Act.(FREEMAN NEWS)

Stupid is as stupid does, and there is no question that guy is stupid because it is common knowledge that just being in the presence of a minor is illegal, no less taking semi nude photos of them.

I've actually been searching all over the net about it. I gBut I was searching for him it by name. I was told he was being questioned. Word like this tends to spread very fast in Bogo. Daanbantayan is very close to Bogo..I hadn't seen him in about five months. He left the Philippines in Nov. and had returned in Jan. He had lived about two blocks from me and I thought he still lived there though I had been wondering if he had moved. For some reason, I had a sense that he had moved.If his GF is three months pregnant, then it is not his. He wasn't here three months ago. I was surprised she was still here for him when he got back. I looked on his Facebook page yesterday and saw that he had become engaged a couple of weeks ago. I didn't know that either.Well, he doesn't seem to realize it yet but his life is over. It will take a miracle for him to get out of this.

Yeah but that's not Philippine press. They are not bound by Philippine law. There was a bill or maybe just a debate in the Philippines senate regarding changing that clause in the Anti-Human Trafficking act. Sheryl is in quotes because that is not her real name. Local Tsismis included her real name. I don't remember it but that wasn't it. Police are probably not even giving that out but someplace there is probably a public record of Joe's arrest so he got the name there perhaps. Or police did release that, not sure. But yep, that's the dude that fell to the temptation of money. I feel certain more will be coming out. He's done. It was such a stupid thing to do. I can't believe he even brought underage girls into it.I'm working on a newsletter by subscription and I wrote an article there and titled it "I'm stupid, arrest me." He should have just planted it on his forehead.I think even the Philippine press could likely publish the names before he is charged but I'm not certain of that. Plus there would be the possibility he was charged between the time a story was written and the time it went to press. Usually the article in the Philippines will state that the names of have been changed because of the Anti-human Trafficking law but he hasn't been charged so they said it was due to the nature of the offense. I also don't know if the Anti Child Abuse act (or if that is the correct name) has such a clause. I've read it. My background is rooted in law, not a lawyer, an accountant and I guess it is ingrained in me. But I also no longer have the patience to deeply study it. I just found another article on the story. No need to post it but it is Cebu Daily News and the did include Joe's name.So I went and looked at the law. It only becomes private once an investigator says so. It appears they wish to get his name out there.Section 6. Confidentiality. - At any stage of the investigation, prosecution and trial of an offense under this Act, law enforcement officers, prosecutors, judges, court personnel and medical practitioners, as well as parties to the case, shall recognize the right to privacy of the trafficked person and the accused. Towards this end, law enforcement officers, prosecutors and judges to whom the complaint has been referred may, whenever necessary to ensure a fair and impartial proceeding, and after considering all circumstances for the best interest of the parties, order a closed-door investigation, prosecution or trial. The name and personal circumstances of the trafficked person or of the accused, or any other information tending to establish their identities and such circumstances or information shall not be disclosed to the public.In cases when prosecution or trial is conducted behind closed-doors, it shall be unlawful for any editor, publisher, and reporter or columnist in case of printed materials, announcer or producer in case of television and radio, producer and director of a film in case of the movie industry, or any person utilizing tri-media facilities or information technology to cause publicity of any case of trafficking in persons.

Just curious Rusty since you knew of him,what are your thoughts on his intelligence as a person or understanding of the Philippines laws.Do you think he was unwittingly doing what he was doing or knew damned well that it was against the law.No need to answer if it could cause problems.

Follow up American caught with topless minors charged An American who was arrested in Daanbantayan after being caught filming seven topless females, three of them minors, wrestling has been charged with qualified trafficking in persons, violation of the child pornography law and syndicated child pornography before the Cebu City Prosecutor's Office.
