They were long cleared by the Cebu court and police authorities but the stain of the kidnap-homicide charges continue to linger on Norwegian national Sven Berger and his Cebuana fiancee Karen Esdrelon.Assisted by lawyer Glen Villariza, the couple decided to request the Cebu Provincial Prosecutors' Office to declare them innocent of the charges in relation to the kidnap-murder of six-year-old Ellah Joy Pique.In their pleading filed last Friday, Berger and Esdrelon said though the complaint of kidnapping with homicide against them were dismissed, they weren't completely vindicated.Instead of saying there was "insufficiency of evidence," the couple said the prosecutors should cite their innocence as reason in dismissing the complaint."With all due respect, the word and phrase 'dismiss due to insufficiency of evidence' still carries with it a negative connotation which is very humiliating," Villariza said. Child porn?Really? Adult DVD's and a few sex toys, all given back. There NEVER WAS any child porn....EVER, EVER, EVER. But hey, at least his girlfriend will go to jail, as they have asked her if she can dance. Such professionalism...Do you know, before profiling and back in the before electricity days....the mutilated corpses of a serial killer were thought to of been caused by....werewolves and vampires. Yeah, that's how these monsters were created, after all...what human could do such horrible things. Then came the ripper murders, and it HAD to be a punk lowlife who was doing these crimes. Wrong again. Has the crime fighting ability of the Philippines gone beyond those times? Maybe required TV watching of criminal minds or csi....and then give them a degree. But now the blame has been shifted so many times wit zero evidence, and the real evidence is cold. Probably the best we can hope for now, is the real killer gives himself away in some drunken state in the future ! I don't think you could trust the cops there to find there own bum with both hands ! But now the blame has been shifted so many times wit zero evidence, and the real evidence is cold. Probably the best we can hope for now, is the real killer gives himself away in some drunken state in the future ! I don't think you could trust the cops there to find there own bum with both hands ! Mr Lee Posted August 4, 2011 Author Posted August 4, 2011 Prosecutors can't declare Berger, Esdrelon innocentCEBU, Philippines - The Provincial Prosecutor’s Office denied the motion filed by the mistaken suspects in the abduction and killing of six-year-old Ellah Joy Pique for the issuance of an amended resolution declaring them innocent of the crime.Provincial Prosecutor Jane Pepita Petralba approved the comment of prosecutors Marlon Atillo and Marvin dela Peña to deny the motion filed by Sven Erik Berger and Karen Esdrelon as their office was only tasked to determine any probable cause for indictment against the couple.“To categorically declare herein respondents as innocent of the crime charged against them is beyond the scope, function and jurisdiction of this Office as it has no authority to do so,” their comment read.The prosecutors said the concern of Berger and Esdrelon that the word “dismissed due to insufficiency of evidence” gave negative connotation to them cannot convince the office to change their resolution as any finding made after a preliminary investigation does not destroy the constitutional presumption of innocence of persons accused.“We find that the evidence against the respondents is insufficient to indict them of the crime charged. This goes to show that the movants could not even be formally charged in court because the investigating prosecutors did not find the evidence submitted to them sufficient to support an indictment,” comment reads.Berger and Esdrelon filed the motion before the Provincial prosecutor’s Office assisted by their lawyer Glenn Villariza.They alleged that the phrase “dismissed due to insufficiency of evidence” still carries negative impact, especially in Norway.
